THE STATES
are asked to decide whether they are of opinion -
in
accordance with Part II of the Second Schedule to the Data Protection (Jersey)
Law 1987 to appoint the following as members of the Data Protection
Tribunal for a period of three years –

REPORT
Under the terms of the Data Protection (Jersey) Law
1987, the States is empowered to appoint a chairman and four other members from
whom a Data Protection Tribunal will be constituted. The purpose of the Tribunal
is to provide a right of appeal for those who are aggrieved at decisions made
by the Data Protection Registrar. As a consequence, members of the Tribunal
must be seen to be independent of the Registrar.
It is a requirement of the legislation that the
chairman shall be an advocate or solicitor of not less than seven years’
standing and that the chairman and members will hold office for three years and
shall be eligible for re-appointment. The Tribunal was constituted for the
first time three years ago and the following appointments were approved by the
States –

The original intention in selecting members was that
there would be a balance between those who might be seen to be representing
industry and commerce and those acting on behalf of the citizen.
All of the existing members have signified that they
would be willing to serve a further term of three years.
Details of those who are recommended for office are as
follows –
Advocate
Peter Harris: Advocate Harris was
born in Jersey in June 1957 and was educated locally at Victoria College before
obtaining a B.A. Hons in Law at Kingston Polytechnic. He became a Member of the
Middle Temple, Member of the Society for Computers and Law and Chairman of the
Law Society Information Technology Sub-Committee. He returned to Jersey in 1986
and was employed by Mourant, de Feu and Jeune and was called to the Jersey Bar
in March 1990. Advocate Harris became a partner specialising in IT and Internet
Law at Crills in September 1996. He is married with two sons.
Dr. Rodney
Challinor: Dr. Challinor was born in
Cairo, Egypt in August 1941. He was educated locally at Victoria College before
obtaining a B.Sc. (Special) Hon 1 in Physics and a Ph.D. in Upper Atmosphere
Physics at Kings College London. He worked in Australia for three years as a
Senior Research Scientist, a short time in London and then one year in Canada
as an Associate Professor. In 1970 he founded Channel Data Processing, now the
Sigma Group, and became Managing Director. Mr. Challinor retired in 1995 but
remains a director, consultant and main shareholder. He is married with three
daughters and was Chairman of the Board of Governors at Jersey College for
Girls for the period 1994 - 1998. He also has an active interest in the Jersey
Music Club, Jersey Eisteddfod, Jersey Arts Centre and St. Helier Yacht Club.
Mr. Cyril Le
Bail: Mr. Le Bail was born in St.
Ouen in 1934 and educated in Jersey. He has a wide variety of work experience,
including delivery-salesman, gardener, docker, labourer, coach driver and six
years in the Royal Navy. After this he entered teaching as a career and gained
an external honours degree in English from London University. Mr. Le Bail
taught at Hautlieu for 30 years, holding posts of Head of Sixth Form and Head
of General Studies. He is a past President of the Jersey Teachers’ Association
and former member and ex-Chairman of the environmental pressure group
‘Concern’.
Mr. Francis
Le Gresley: Mr. Le Gresley was born
in Jersey on 9th June 1951 and educated at St. Lawrence Primary School and
Victoria College. He started a career in banking during 1968 and qualified as
an Associate of the Chartered Institute of Bankers in 1977. Since then he has
held various managerial positions before leaving the industry in 1990. Mr. Le
Gresley became manager of the Citizens Advice Bureau in 1992.
Mrs. Toni
Roberts: Mrs. Roberts was born and
educated in Birmingham, England. For thirteen years she worked for Crill,
Cubitt Sowden and Tomes as Probate Manager, and for the last sixteen years has
worked for Chase Bank and Trust Company (C.I.) Limited as a General Manager and
now has international sales and product development roles. She is an Associate
of the Chartered Institute of Secretaries and Administrators and has an MBA
from the University of Leicester. Mrs. Roberts is married with two children and
was formerly Chairman of the Jersey Branch of Chartered Institute of
Secretaries and Administrators, Secretary of the Jersey Spina Bifida
Association and is a committee member of the Institute of Directors. Interests
include snow-skiing and gourmet food.
The Policy and Resources Committee has no hesitation
in recommending the re-appointment of the chairman and the members of the Data
Protection Tribunal for a further period of three years.
There are no
additional financial or manpower implications for the States arising from this
proposition.
